The website has for object the sharing of photographs and the organization of free photographic contests. The website permits participating in contests, voting and participating in Forums...

The proposed prizes are without obligation of purchase according to the modalities of the present regulation. They are accessible via the website which is a site for the sharing of photographs and game contests.

Article 2: The participants

Anyone with an interest in photography and having created a member space. (private individual or legal entity, adult or minor with a parental authorization).

Are excluded from any participation and the benefit of any endowment, whether directly or indirectly, all the staff and volunteers of the organizer.

Article 3: Conditions of participation

These contests are open to members of the site

To become a member, you must create a member area. For this, any private person or legal entity, major or minor with parental agreement must complete the registration form.

The organizer reserves the right to carry out all necessary verifications concerning the identity, postal and / or electronic address of the participants. Participation in the contests implies for all participants the full and unreserved acceptance of these rules.

Failure to comply with these rules will automatically cancel the participation and the possible award of prize(s).

Moreover, participation in the contests is made via the Internet, it implies knowledge and acceptance of the characteristics and limits of the Internet, and more generally the terms of use of the site (see Terms of Use).

Article 3: Rules for participation

3.1 To participate in the contests the member of the site must register by completing the registration form and filling in all required fields (email, surname, first name). The form will be available on the website .

The User who holds an account becomes a member of the Site (hereinafter the "member"). See the TOU for the procedure for creation of accounts.

The User can not use watermarks on his pictures

Article 4: Selection of Prizewinners

4.1 The winners of the prizes will be chosen by a jury chosen by the organizer.

4.2 The winners will be contacted by email by the organizer. If a winner fails to come forward within one month of reception of this email, he will not be entitled to the prize awarded to him. Therefore, the next member in the ranking will then be designated in his place.

4.3 By the sole acceptance of the prize, the member authorizes the organizer to use his pictures and his copyright in any public-promotional event, on the website and on any affiliated site or support, without such use giving rise to any rights or remuneration other than the prize won

4.4 The winners must comply with the regulations. If they do not meet the criteria of this regulation and the description of the contest, , their prizes will not be awarded

Members shall allow all verifications concerning their identity, age, postal address or the loyalty and sincerity of their participation. In this respect, the organizer reserves the right to request a copy of the winner's ID before sending the prize. Any false declaration, false identification or address will result in the immediate elimination of the participant and the cancellation of the prizes.

Article 5: Prizes

The prizes will be given to the Member by any means deemed necessary by the organizer (mail, email, transport ...). In the case of a financial valuation, payment by Paypal will be privileged by the Organizer.

5.2 If a winner does not wish to benefit from his prize, the prize will then be offered to the second and then the third prize-winner and so on in the order of the ranking. If none of these people wish to take advantage of the prize, the organizer would be obliged to cancel it.

5.3 The organizer cannot be held responsible for sending prizes to an inaccurate address due to the negligence of the winner. If the prizes cannot be delivered to the recipient for any reason, independently of the organizer's will, they will definitely remain the property of the organizer.

5.4 The prizes are not interchangeable against another object or against any monetary value and cannot give rise to a partial or total reimbursement. Members are advised that the sale or exchange of prizes is strictly prohibited.

Article _6: Intellectual Property rights

The general structure of the website, as well as the texts, graphics, images, sounds and videos composing it, are the property of the publisher. Any representation and/or reproduction and/or partial or total exploitation of the contents and services proposed by the site by any process whatsoever, without the prior authorization and in writing of ACT'IMAGE is strictly forbidden and would be liable to constitute an infringement of Articles L 335-2 and following of the Code of Intellectual Property.

ACT'IMAGE grants to users and members a free, personal, non-exclusive and non-transferable right to access and use the site, subject to the acceptance of the TOU.

Any other rights are expressly excluded without our prior written consent.

The content (other than the content of the Members) included or accessible on or through the Site, including any text, graphics, logos, names, marks, designations, tabs, features, images, sounds, data, and any other hardware or software is the exclusive property of ACT'IMAGE, protected by intellectual property law, and is subject to the laws and regulations applicable in this matter.

Any unauthorized reproduction would constitute an infringement punishable by articles L. 335-2 and following of the Code of the intellectual property.

The content of must not be downloaded, copied, altered, modified, deleted, distributed, transmitted, distributed, sold, rented, leased or exploited (in whole or in part) in any manner whatsoever, without the express written consent of ACT’IMAGE.

The user agrees not to use or exploit the Content of the Site for any purpose other than those referred to in these TOU.

Furthermore, the user is not authorized to modify, improve, edit, translate, decompile, disassemble or create one or more derivative works from the content of the website (in all or in part), unless this possibility has been expressly granted by or by the owners of this content(s), under a separate agreement.

Article 7: Game with no obligation to purchase

The reimbursement of the connection costs incurred for participation in the Competition will be limited to a maximum of 3 minutes of connection, based on the cost of local communication at the France Telecom rate in force at the time of writing of this regulation (0.16 euros per minute).

Participants who do not pay a connection fee related to the length of their communications (holders of an "unlimited" subscription, ADSL cable users ...) will not be able to obtain a refund.

Reimbursement will be made upon written request to the organizer. Participants must clearly indicate their full name, first and last name and full address, and must include a R.I.B (or a R.I.P.) as well as a copy of the supporting invoice with the dates and times of the connection clearly marked.

Reimbursement request will be made on the basis of a simple letter.

Article 8: Filing of regulations

In accordance with the French law of 2014-1545 of December 20, 2014, this regulation has not been deposited with a bailiff but can be consulted on simple request by email ( or by letter (19, Cité Dutrey, 33300 Bordeaux) enclosing a pre-stamped self-addressed envelope at the applicable rate.

Article 9: Personal data

9.1 It is recalled that in order to participate in the prizes, members must necessarily provide certain personal information concerning them (name, address, e-mail address ...). This information is recorded and saved in a computer file and is necessary for their participation to taken into account and for sending prizes. This information is intended for the organizer and may be transmitted to its technical service providers and to a service provider for the dispatch of prizes.

9.2 By participating in the contests, the member may also request the organizer subscribes him to its electronic newsletter. The data thus collected can be used within the legal framework.

9.3 In accordance with French law n° 78-17 of 6 January 1978 relative to data processing, files and freedom, participants have the right to access, rectify and delete data concerning them. To exercise these rights, members must send a letter to the organizer's postal address.

Article 10: Litigation

This Regulation is subject to French law.

To be taken into account, any challenges concerning the contest must be made in writing to the oganizer's postal address and no later than ninety (90) days after the deadline for participation in the contest as indicated in these rules.

In case of persistent disagreement on the application or interpretation of this regulation, and in the absence of amicable agreement, any dispute will be submitted to the competent court of Bordeaux, to which exclusive jurisdiction is granted.
